introduced the following bill; which was read twice and referred to the
Committee on Environment and Public Works

A BILL

To remove the lesser prairie-chicken from the lists of threatened
species and endangered species published pursuant to the Endangered
Species Act of 1973, to amend that Act to exclude the lesser prairie-
chicken from the authority of that Act, and for other purposes.

Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1.

(a) In General.--Notwithstanding any other provision of law, the
lesser prairie-chicken (Tympanuchus pallidicinctus), including each
distinct population segment of the lesser prairie-chicken (Tympanuchus
pallidicinctus), is removed from the lists of threatened species and
endangered species that are published pursuant to the Endangered
Species Act of 1973 (16 U.S.C. 1531 et seq.).

(b) Exclusion of Lesser Prairie-Chicken From Listing.--
Section 4 (a) of the Endangered Species Act of 1973 (16 U.

(a) of the Endangered Species Act of 1973 (16 U.S.C. 1533

(a) ) is amended--

(1) in paragraph

(1) , in the matter preceding subparagraph
(A) , by striking ``The Secretary shall'' and inserting ``Except
as provided in paragraph

(4) , the Secretary shall''; and

(2) by adding at the end the following:
``

(4) Applicability to Lesser Prairie-chicken.--The Secretary may
not make a determination under this subsection that the lesser prairie-
chicken (Tympanuchus pallidicinctus) is an endangered species or a
threatened species.''.
