A BILL
To amend title 18, United States Code, to establish a criminal penalty
for unauthorized access to Department of Defense facilities.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1.
This Act may be cited as the ``Guarding and Administering Trespass
Enforcement, Controlling Restricted Areas, and Stopping High-risk
Encroachment Recidivism and Sabotage Act'' or the ``GATE CRASHERS
Act''.
SEC. 2.
(a) In General.--Chapter 67 of title 18, United States Code, is
amended by adding at the end the following:
``
Sec. 1390.
``
(a) In General.--It shall be unlawful, within the jurisdiction of
the United States, without authorization to go upon any property that--
``
(1) is under the jurisdiction of the Department of
Defense; and
``
(2) has been clearly marked as closed or restricted.
``
(b) Penalties.--Any person who violates subsection
(a) shall--
``
(1) in the case of the first offense, be fined under this
title, imprisoned not more than 180 days, or both;
``
(2) in the case of the second offense, be fined under
this title, imprisoned not more than 3 years, or both; and
``
(3) in the case of the third or subsequent offense, be
fined under this title, imprisoned not more than 10 years, or
both.''.
(b) Table of Sections Amendment.--The table of sections for chapter
67 of title 18, United States Code, is amended by adding at the end the
following:
``1390. Unauthorized access to Department of Defense facilities.''.
