A BILL
To amend the Public Health Service Act to create a special rule for
treating trained individuals as trained personnel of a school for
purposes of giving preference to States for children's asthma treatment
grant programs, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1.
This Act may be cited as ``Dillon's Law''.
SEC. 2.
ADMINISTER EPINEPHRINE AT SCHOOLS.
(a) In General.--

Section 399L
(d) of the Public Health Service Act

(d) ) is amended--
(1) in paragraph
(1)
(F) --
(A) in the subparagraph heading, by striking
``School personnel'' and inserting ``Trained
personnel'';
(B) in the heading for clause
(ii) , by striking
``school'' and inserting ``trained''; and
(C) by adding at the end the following:
``
(iv) Special rule.--For purposes of this
subparagraph, an elementary school or secondary
school in a State may treat an individual who
is not an employee of the school as being part
of the trained personnel of the school if--
``
(I) the individual meets the
requirements of paragraph
(3)
(E) ; and
``
(II) the State attorney general
reaffirms the certification of the
State under subparagraph
(G) , taking
into account the treatment of
individuals authorized by this
clause.''; and
(2) in paragraph
(3)
(E) , in the matter preceding clause
(i) , by striking ``, such as the school nurse''.
(b) Epinephrine Delivery Systems.--
