<p><strong>Protecting American Energy Production Act</strong></p><p>This bill prohibits the President from declaring a moratorium on the use of hydraulic fracturing unless Congress authorizes the moratorium. The bill also expresses the sense of Congress that states should maintain primacy&nbsp;(authority) for the regulation of hydraulic fracturing for oil and natural gas production on state and private lands.</p><p>Hydraulic fracturing, or fracking, is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the formation.</p>

Ms. Boebert introduced the following bill; which was referred to the
Committee on Natural Resources, and in addition to the Committee on
Energy and Commerce, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall
within the jurisdiction of the committee concerned

A BILL

To prohibit a moratorium on the use of hydraulic fracturing.

Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1.

This Act may be cited as the ``Protecting American Energy
Production Act''.
SEC. 2.

(a) Sense of Congress.--It is the sense of Congress that States
should maintain primacy for the regulation of hydraulic fracturing for
oil and natural gas production on State and private lands.

(b) Prohibition on Declaration of a Moratorium on Hydraulic
Fracturing.--Notwithstanding any other provision of law, the President
may not declare a moratorium on the use of hydraulic fracturing unless
such moratorium is authorized by an Act of Congress.
