Here's a comprehensive analysis of H.J.Res. 105:

Executive Summary

This joint resolution is a Congressional disapproval action aimed at nullifying a Bureau of Land Management (BLM) rule regarding land management in North Dakota. Specifically, it would invalidate the "North Dakota Field Office Record of Decision and Approved Resource Management Plan" issued in January 2025, preventing it from taking effect.

Key Provisions

  • Formally disapproves the BLM's North Dakota Field Office management plan
  • Declares that the management plan shall have "no force or effect"
  • Exercises Congress's authority under the Congressional Review Act to overturn agency rules
  • References a GAO determination (dated June 25, 2025) that classified the management plan as a "rule" subject to Congressional review

Impact Analysis

Who would be affected:

  • Bureau of Land Management operations in North Dakota
  • Stakeholders involved in North Dakota public lands management
  • Local communities and businesses dependent on BLM-managed lands
  • Energy, agriculture, and other industries operating on federal lands in North Dakota

Potential implications:

  • Would maintain previous land management practices rather than implementing new ones
  • Could affect resource development, conservation efforts, and land use permissions
  • May impact existing agreements or planned projects under the new management plan

Funding & Implementation

  • No direct funding provisions are mentioned in the resolution
  • Implementation would be immediate upon passage
  • Would require BLM to continue operating under previous management plans
  • Could require BLM to develop new management plans that address Congressional concerns

Political Context

  • This is a joint resolution using the Congressional Review Act (CRA)
  • Represents a direct challenge to executive branch agency action
  • Typical of congressional oversight of administrative rulemaking
  • Likely reflects tension between congressional and executive views on land management policy

Notable aspects:

  • Passed the House on September 3, 2025
  • Received in the Senate on September 4, 2025
  • Includes formal GAO determination of the plan as a "rule" under CRA
  • Represents a significant use of Congressional authority to check administrative action

This resolution demonstrates Congress's active role in overseeing federal land management policies and its willingness to intervene in agency decisions affecting state-level operations.
